Insurance Bad Faith
What Should Your Insurance Company Do

How To Save Without Using Your Savings
-----------------------------------------------------------------------------------------------

The insurance company added insult to injury by denying your claim even though you are disabled. David Allen & Associates is here to help you through the legal battle to get the benefits for which you paid. Unfortunately, this process is rarely quick. The first appeal will take six months, a second appeal, sometimes allowed, will add an additional three months. These appeal periods are often extended by the insurance company. If your claim goes to Court, the claim will be extended another year or two.

We will be doing everything we can to get your benefits approved as quickly as possible. As you know, we are paid only after we achieve success for you, so we are motivated to succeed as soon as possible. There are things you can do, too, to help yourself during this extended fight with the insurance company:

  1. Contact all your utilities (power and telephone) regarding payment reductions for those with low incomes (see your bills for contact numbers);
  2. Contact a disability Ombudperson for community assistance (Sacramento Area DHS is (916) 875-3555);
  3. See Housing Now for housing information for your area http://www.housingnowresource.org;
  4. Contact your vehicle insurance. It is likely that the reduced driving you do with the elimination of a commute will reduce your yearly insurance rate;
  5. Consider everything for which you make monthly payments now, before you run out of funds. Can any of those services be reduced or even canceled?
  6. If you think you might be able to go back to work with retraining, contact the EDD and ask about retraining benefits.

    You have a right to the benefits for which you paid while you worked. However, the insurance company will make every effort to deny you payment. For this reason, go forward as if you will not be paid. The funds you eventually receive will be less than your full salary. You will need to see the funds go as far as possible. They may need to last through your retirement.
